Drug Court
The Drug Intervention Court is a program focused on rehabilitation rather than incarceration and hears only drug-related felony cases. Cases are only moved to Drug Intervention Court after a recommendation from the District Attorney and approval from the Drug Intervention Court staff. If the defendant has committed a violent crime along with a drug-related crime, they lose the privilege of participating in Drug Intervention Court.
After being interviewed and approved by the Drug Intervention Court staff, the defendant is sentenced by a judge to a rehabilitation program for a minimum of three years. As a part of this program, participants are subjected to random drug testing and required to meet with other members of the program every week for a docket call. These meetings are led by the judge and open to the public. Upon successful completion of the program, most charges are completely expunged.
Located in Lafayette County, the Third Circuit District Drug Intervention Court serves Benton, Calhoun, Chickasaw, Lafayette, Marshall, Tippah and Union counties.
